Terms of Service

1. Agreement to Terms

By accessing or using Airpen, a product of Almond Group ("Airpen," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not access or use the service.

2. Eligibility & Account Security

You must be at least 13 years old (or 16 in the EEA/UK) to use Airpen. You agree to provide accurate registration details, maintain the security of your authentication credentials, multi-factor keys, and trusted devices, and promptly notify us of any unauthorized account activity. You are solely responsible for all actions conducted through your account.

3. Classroom & Audio Recording Consent

You are solely responsible for complying with all applicable recording, wiretapping, and privacy laws.

Before capturing, recording, or streaming audio from classroom lectures, laboratory sessions, or private meetings into Airpen, you represent and warrant that you have obtained all legally required permissions, notices, or express consents from instructors, speakers, academic institutions, and other participating individuals.

4. Academic Integrity & Acceptable Use

Airpen is designed as an intellectual study companion to accelerate comprehension, structured retention, and active recall. You agree not to use Airpen to:

• Violate university honor codes, school policies, or institutional academic integrity standards.
• Engage in unauthorized exam assistance, cheating, or deceptive submission of coursework.
• Infringe the intellectual property, copyright, or privacy rights of any party.
• Transmit malicious payloads, exploit vulnerabilities, or disrupt infrastructure stability.
• Scrape, reverse engineer, or circumvent rate limits, authentication boundaries, or access controls.

5. User Content & Course Materials

You retain all intellectual property rights and ownership of your submitted notes, audio, documents, and derived study materials. You grant Airpen a limited, non-exclusive license solely to host, process, transcribe, synthesize, and display your content to provide and maintain your workspace.

You represent that you hold all necessary rights or educational fair-use authorizations for any textbooks, lecture slides, or syllabi uploaded to your workspace. We respond promptly to valid copyright infringement notices under the Digital Millennium Copyright Act (DMCA) sent to support@airpen.app.

6. Interactive Code Sandbox (STEM Runtime)

Airpen provides an isolated browser sandbox for executing computational Python scripts and verifying STEM equations. You agree to use the execution runtime solely for educational calculation and algorithm analysis. Running network scans, denial-of-service routines, cryptominers, or unauthorized automated processes is strictly prohibited and subject to immediate account termination.

7. AI Output, Mathematics & Scientific Disclaimers

Airpen leverages artificial intelligence to generate study outlines, LaTeX formulas, flashcards, diagnostic questions, and chemical kinetics calculations. AI-generated outputs may occasionally contain errors, inaccuracies, or incomplete derivations.

Airpen is an educational study aid, not a certified professional engineering, medical, financial, or legal advisory system. You are responsible for independently verifying all critical formulas, calculations, and answers prior to relying on them.

8. Subscriptions, Quotas & Fair Use

Free and Pro tiers may be subject to usage quotas, including audio transcription hours, AI synthesis credits, and cloud storage allocations. We reserve the right to throttle abusive automation or excessive transcription volumes that degrade service performance for other users. Subscription fees are billed in advance on a recurring cycle and can be cancelled at any time through account settings.

9. Service Availability & Termination

We continuously update and enhance Airpen, which may involve modifying or discontinuing specific features. We reserve the right to suspend or terminate accounts that violate these Terms or pose security threats to our platform. You may delete your account at any time via settings.

10. Disclaimer of Warranties & Limitation of Liability

Airpen is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, Almond Group and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, loss of academic standing, data loss, or service interruptions arising from your use of the platform.

11. Changes & Contact Information

We may revise these Terms from time to time. If revisions are material, we will provide at least 15 days notice before new terms take effect. Continued use of Airpen following any update constitutes acceptance of the modified Terms. Questions regarding these Terms should be directed to support@airpen.app.
